1. Acceptance of Terms

By accessing or using Schedchie's services (the "Service"), you agree to comply with and be bound by these Terms of Service (the "Terms"). If you do not agree with these Terms, you may not use the Service. These Terms may be updated from time to time, and your continued use of the Service constitutes your acceptance of any updates.

2. Description of Service

Schedchie provides an online scheduling and social media management platform (the "Service") that allows users to schedule, manage, and post content on supported social media platforms, including but not limited to Instagram, Facebook, YouTube, and TikTok. The Service may integrate with third-party services, including but not limited to Stripe for payment processing. Use of third-party services may be subject to additional terms.

3. User Responsibilities

As a user, you are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account. You are also responsible for ensuring that any content scheduled, uploaded, or posted through the Service complies with the terms and policies of the social media platforms you use.

You agree to immediately notify Schedchie of any unauthorized use of your account or any other breach of security. Schedchie will not be liable for any loss or damage arising from your failure to comply with these responsibilities.

4. Payment and Subscription

Schedchie offers subscription-based access to the Service, with pricing plans subject to change. All payments are processed via Stripe, and you agree to adhere to the terms and policies of Stripe regarding your payments. Fees associated with your selected subscription plan are due at the start of each billing cycle, and you authorize us to charge your payment method accordingly.

Schedchie reserves the right to adjust pricing, offer promotional discounts, or implement new fees with reasonable notice. Any changes to fees will be reflected in your subscription plan, and continued use of the Service after such changes constitutes acceptance.

5. Data Storage and Management

By using the Service, you acknowledge that all scheduled content, including posts, media, and related data, will be stored on Schedchie's servers and in our MongoDB database. While we take reasonable measures to secure this data, you agree that Schedchie cannot guarantee the security or integrity of data and that you use the Service at your own risk.

6. Use of Third-Party Services

The Service may integrate or rely on third-party services, including social media platforms (Instagram, Facebook, YouTube, TikTok), payment processors (Stripe), and others. Your use of the Service must comply with the respective terms and policies of these third-party services. Schedchie is not responsible for the performance or availability of these services.

YouTube API Services: By using Schedchie to access or interact with YouTube, you are agreeing to be bound by the YouTube Terms of Service. Our use of YouTube API Services is subject to YouTube's terms and policies.

7. Intellectual Property

All content, design elements, features, and functionalities of the Service, including but not limited to software, images, logos, text, and trademarks, are the intellectual property of Schedchie or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Service solely for personal or internal business use, in accordance with these Terms.

You may not copy, modify, distribute, reverse-engineer, or create derivative works based on any aspect of the Service without express written permission from Schedchie.

8. Termination

Schedchie reserves the right to suspend or terminate your account at any time, with or without cause or notice, for any violation of these Terms or for behavior that could harm the Service, other users, or third-party services. Upon termination, your access to the Service will cease immediately, and Schedchie reserves the right to delete your account and data.

9. Limitation of Liability

To the maximum extent permitted by law, Schedchie will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service. In no event shall Schedchie's liability exceed the amount you paid for the Service in the twelve (12) months preceding the event giving rise to the liability.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Slovakia, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Slovakia.

11. Changes to Terms

Schedchie reserves the right to modify these Terms at any time. If changes are made, the revised Terms will be posted on our website, and you are responsible for reviewing the updated Terms. Continued use of the Service after changes are made constitutes your acceptance of the revised Terms.
